1 Conclusion of contract, cancellation

1.1 By sending the order by clicking on the field "Book with obligation to pay", the customer submits a binding offer. Only with allocation and sending of the order number by Agent Y - Escape Room Brühl GbR to the customer a contract between the customer and Agent Y - Escape Room Brühl GbR is concluded. The sending of the order confirmation is the delivery of the ticket about the participation in the Escapegame, a birthday or company event. 

1.2 The purchase of vouchers can be revoked in accordance with No. 5.

1.3 When purchasing tickets through participation in Escapegames, cancellation or postponement of the date is not possible (cf. No. 5.1.)

2 Price components & payment modalities

2.1 The total price of the order is due for payment immediately after conclusion of the contract for the payment methods "Paypal", "Sofortüberweisung" and "Rechnung", should these payment methods be offered. 

2.2 If the payment method "card payment on site" is offered, the total price of the order is due on the day of the event, in deviation from 2.1, and must be paid by EC card or credit card on site at the branch before the start of the game.

2.3. If the payment method "cash on site" has been selected, the total price of the order is due on the day of the event in deviation from 2.1. and 2.2. and must be paid in cash on site at the branch before the start of play or use.

2.4 If the number of players differs from the number stated in the reservation, the difference (additional payment or refund) will be reconciled at the cash desk before the start of the game. The maximum number of players per game room (6 adults or 8 children & youth) may not be exceeded.

3 "Tickets" and exchange/cancellation conditions

3.1 The ticket purchased by the customer for participation in the Escapegame entitles the customer and other persons named by the customer to participate in the booked game on the date noted on the ticket (the order confirmation) at the specified time. 

3.2 If the customer appears late, the game time will be reduced according to the delay. In the event of non-appearance, the customer's claim to the execution of the Escapegame shall be forfeited. The obligation to pay the total price of the order remains in place cf.

3.3 The offered Escapegames are usually not suitable for children under 7 years. Children under 7 years of age can therefore not participate in the Escapegames. The minimum age may differ for individual rooms. This is then noted on the ticket page and the minimum age there applies.

3.4 Children and young people under the age of 14 must be accompanied by a parent or guardian. Otherwise, admission may be denied.

3.5 Eine Stornierung der Eintrittskarten ist kostenfrei nur bis 72 Stunden vor dem geplanten Spielbeginn möglich, bei Team Events (10 Spieler oder mehr) nur bis eine Woche vor dem geplanten Spielbeginn. 

3.6 Eine kostenfreie Umbuchung auf einen anderen verfügbaren Termin ist bis 24 Stunden vor dem Spielbeginn möglich, bei Team Events (10 Spieler oder mehr) nur bis 3 Tagen vor dem geplanten Spielbeginn. 

3.7 Cancellations less than 24 hours before the start of the game are due the full price. 

3.8 Bei Team Events (10 Spieler oder mehr) wird gebeten, spätestens 3 Tage vor dem geplanten Termin die Anzahl von Spielern verbindlich zu bestätigen. Sollte die tatsächliche Anzahl von Spielern niedriger sein (abzüglich einer Kulanz von 2 fehlenden Spielern), ist der Preis für die geplante Anzahl von Spielern fällig.

4 vouchers

4.1 The vouchers are valid exclusively for the payment of tickets via participation in Escapegames offered by Agent Y - Escape Room Brühl GbR.

4.2 A claim for cash payment of the vouchers against Agent Y - Escape Room Brühl GbR is excluded as long as the service is offered. 

4.3 The vouchers issued by Agent Y - Escape Room Brühl GbR are valid until the end of the third year following the year of purchase.

5 Right of withdrawal and model withdrawal form

5.1 When purchasing tickets via participation in Escapegames, a contract for the provision of services in connection with leisure activities is concluded between Agent Y - Escape Room Brühl GbR and the customer, which provides for a specific date or period for the provision (cf. § 312 g para. 2 no. 9 BGB). Therefore, according to § 312 g para. 2 no. 9 BGB, there is no right of withdrawal for the customer, regardless of the chosen method of payment. Each purchase of tickets via participation in Escapegames is thus binding immediately after confirmation according to 2.1 by Agent Y - Escape Adventures GbR and obligates the customer to pay the total price of the order.

5.2 In the case of a purchase of a voucher which takes place in the simultaneous physical presence of the contractual partners or their authorized representatives (e.g. purchase in the branch), there is no distance contract within the meaning of § 312 b BGB. The customer therefore has no right of revocation.

5.3 For all other voucher purchases, the following applies to contracts with consumers:

Right of withdrawal

You have the right to cancel this contract within fourteen days, but no later than 24 hours before the scheduled start of the game without giving any reason. 
The withdrawal period is fourteen days from the conclusion of the reservation.
To exercise your right of withdrawal, you must, 
Agent Y - Escape Room Brühl GbR, Kölnstr. 29-31, 50321 Brühl, +49 2232 2169040, info@agenty.de by means of a clear declaration (e.g. a letter sent by mail or e-mail) about your decision to revoke this contract. To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of the revocation

If you withdraw from this contract, we must refund all payments we have received from you immediately and at the latest within fourteen days of the day on which we received notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment.

End of the cancellation policy and the model cancellation form

5.4 In the event of revocation by the customer, the following shall apply: 
Agent Y - Escape Room Brühl GbR will deactivate the voucher. If the voucher has already been paid before revocation, Agent Y - Escape Room Brühl GbR will refund the purchase price to the customer.

6 Retention of title

6.1 If the customer is a consumer, Agent Y - Escape Room Brühl GbR retains ownership of the purchased item until full payment of the total price of the order. The corresponding security rights can be transferred to third parties. 
6.2 If the customer is an entrepreneur acting within the scope of its entrepreneurial activity or a special fund under public law or a legal entity under public law, Agent Y - Escape Room Brühl GbR retains ownership of the purchased item until all outstanding claims from the business relationship with the customer have been settled. The corresponding security rights can be transferred to third parties. 

7 Offsetting; right of retention for purchase on account

7.1 The customer can only offset with counterclaims that have been legally established or recognized by Agent Y - Escape Room Brühl GbR or are undisputed. 
7.2 The customer shall only have a right of retention if and to the extent that the counterclaim results from the same contractual relationship. 

8 Limitations of liability, exclusion of withdrawal in the event of certain breaches of duty

8.1 Agent Y - Escape Room Brühl GbR is liable in the following cases in any case without limitation:

- according to the product liability law
- for damage caused intentionally or by gross negligence
- in case of fraudulent concealment of defects
- for damages resulting from injury to life, body or health
- for damages resulting from the breach of a warranty. 

8.2 As far as a violation of essential contractual obligations (so-called cardinal obligations) is only based on simple negligence, the liability of Agent Y - Escape Room Brühl GbR is limited to the compensation of the contract-typical and foreseeable damage.

8.3 Except for the cases mentioned in paragraphs 8.1 and 8.2, Agent Y - Escape Room Brühl GbR is not liable for damages caused by simple negligence.

8.4 As far as the liability of Agent Y - Escape Room Brühl GbR is excluded or limited according to clauses 8.1 to 8.3, this also applies to the liability of its vicarious agents.

9 Choice of Law, Place of Performance, Out-of-Court Dispute Resolution

9.1 The law of the Federal Republic of Germany shall apply exclusively.

9.2 If the customer is an entrepreneur according to § 14 BGB, the sole place of performance for the delivery and service as well as the payment is the registered office of Agent Y - Escape Room Brühl GbR.

9.3 The European Commission provides a platform for online dispute resolution (OS), which you can find here:

Consumers have the possibility to use this platform for the settlement of their disputes.

10 House rules Agent Y - Escape Room Brühl GbR, Brühl

With access to the event rooms of Agent Y - Escape Room Brühl GbR, the customers and visitors recognize the validity of the following house rules regulated by private law: 

1. Persons who are conspicuous by wearing fascist and / or inhuman emblems, brands and / or by fascist and / or inhuman statements will be expelled from the event premises and receive an immediate ban!
2. Cutting, shooting or stabbing weapons are prohibited in the event rooms. 
3. The making of photographic, audio, video or other media recordings
   for commercial use in the facility without the express prior consent of Agent Y - Escape Room Brühl GbR is not permitted. We also ask in the sense of the game experience before the start of the game to hand over image and sound recording devices, especially mobile devices. 
4. Animals are not allowed in the event rooms for the safety of our customers and for their own protection.
5. Visitors who 
   - are obviously under the excessive influence of drugs or alcohol,
   - have a suspicion of a contagious disease within the meaning of the Federal Epidemic Diseases Act or the Infection Protection Act or similar safety-threatening diseases, 
   may be denied access to the premises. 
6. Smoking is not allowed in the rooms. Smoking is allowed only on the balcony.
7. Marked escape routes and doors may not be blocked or their function altered in any way. All escape routes must be kept clear at all times; escape doors may only be opened in an emergency.
